Considering the litigious nature of our society I would be concerned that if you had to use the weapon in self-defense it could potentially be used against you. Perhaps they would say if he is knowingly carrying a 'defective' weapon that may be an indication of his lack of judgment. This is the reason I sent mine back, though I initially shared your sentiment.

I'd be interested to hear the opinion of Craigepo or one of the lawyers on this board, though.

I received an email from Springfield today. The wife's XDs is in transit and will be delivered by FedEx to our door in two days. For our trouble it is coming with a free 7-round magazine.

Has anyone else received the good news?

I expected they would do something like that.

Class act.

Shipped to Springfield 28 AUG, delivered to my door 23 OCT. Hopefully everyone will be receiving theirs soon.

The pistol was returned inside a small plastic case and there was a red plastic empty chamber indicator inserted into the pistol. Also in the case was the promised 7-rd magazine with extra sleeve.

Considering that Springfield did not have a repair facility in place when they announced the recall, I'm reasonably pleased with the turnaround time. The extra magazine was a nice bonus since I was planning to purchase a fourth 7 rounder anyway. Now we just have to get to the range and finally shoot this thing.

I will be more than a little disappointed if mine does not come back in it's original case like I sent it. Mine too was received by SA on 9-3 so hopefully it will not be long before I get it back. It would be interesting to hear an exact figure on how many were returned for alteration.

Please place your cleaned and unloaded pistol without magazines or accessories in a shipping box prior to taking it into FedEx. Shipping it in the original XD-S black case is acceptable, however the case must be in a shipping box when taking it into FedEx.
I suppose if you shipped it in something less than the original box, they will put it in a plastic box to return it to you.

I took the instructions (without accessories) to mean do not send it in the original case that came with it. And, well, I have the pistol in my safe now and the original case is still in my gear room.

A friend who shipped his at the same time (we went to FedEx together), also sans case, still has not received news of his shipping yet.

The instructions specifically said NOT to ship it to them in the original box.

Hope you get yours back.

Still no word on my pistol. Hopefully soon.

That may have been their initial guidance. From their website:

Quote:
Q9: How do I package the pistol for return? In the original case?

A9: Please safely and properly unload your XD-S™ pistol and properly clean it before returning. Your pistol can be shipped back to us in the original case inside a shipping box. If you do not have the original case, the pistol can be wrapped securely in bubble wrap or similar material, and placed in a sturdy shipping box. Please ship only the pistol. We do not need any magazines or additional accessories to complete the upgrade. Please do not use a FedEx envelope. FedEx boxes are free at the facility and they work well for your return. Please ask for the "free FedEx priority box."

Yeah, they must have modified the instructions. I wanted to send mine in the original box but i read instructions that said not to. A moot point at this juncture. I hope everyone gets theirs back quickly with all accompanying accessories.

Got my notification this afternoon and my XDs will be back on Wednesday, also with an extra magazine. Going to have it out on the range this Sunday!
