Having had hours of HIPPA training and having acted as an expert med mal defense witness on one occasion, I've never heard of anything like that. It is difficult to subpoena private health records and difficult to get permission for healthcare professionals to testify on a patient's medical conditions and treatments. That being said, I do know that insurance companies are able to access old medical records to determine pre existing conditions. But that is, I believe, only with the consent of the applicant. It will be very interesting to find out the rest of this story. Of course, once ACA (obamacare) kicks in, the government will be present to witness your prostate exams.....Or at least have unprecedented access to your medical records, being the insurer.
